The short version

  • The Smart Student Masterclass is covered by our “Smarter in 30 Days or It's Free” guarantee. Email us within 30 days of purchase and we refund every cent. No hoops, no completion requirements. Downloadable bonuses are yours to keep.
  • Subscriptions (like the Smart Student Academy) can be cancelled any time. Cancelling stops future charges; periods already started are not refunded except where the law requires.
  • Your data is used to run your account, deliver your courses and improve our teaching. We never sell it. Email [email protected] to access or delete it.
  • Some help on our sites is provided by AI assistants (including our study tools and chat). We tell you the truth about this any time you ask, and a human is always available at [email protected].
  • Nothing in these terms removes your rights under the Australian Consumer Law or equivalent consumer laws where you live.

1. Terms of Use

These Terms govern your use of the DELTA YOU websites (including deltayou.com.au and smartryou.com), courses, memberships, coaching, tools and communities (together, the “Services”). By using the Services you agree to these Terms. DELTA YOU is operated from New South Wales, Australia.

1.1 Who can use the Services

  • Our programs are designed for students (typically aged 10+) and their parents. If you are under 18, a parent or guardian must make the purchase, create the account, or give their consent, and they accept these Terms on your behalf.
  • The person who pays is the contracting party. Parents and guardians are welcome to sit in on any session with their child.

1.2 Your account and access

  • Access is personal and non-transferable. One enrolment covers one student (family sharing between a parent and that same student is fine).
  • Keep your login details private. You are responsible for activity under your account.
  • “Lifetime access” means the lifetime of the product: for as long as we actively offer and host it, and no less than a reasonable period after purchase. If we ever retire a product, we will give you reasonable notice and a fair alternative or download.

1.3 Course format and live elements

  • Masterclass sessions run on a recurring schedule. The teaching presentation is professionally produced (pre-recorded); questions asked during a session are answered live in the session chat by our team, which may include AI assistants (see section 4).
  • Schedules, bonuses, hosts and content may be improved or updated over time. Updated editions are included where lifetime access applies.

1.4 Intellectual property

  • All content (videos, frameworks including the 7 Smart Skills™ and the DELTA Method, workbooks, quizzes, slides, branding) is owned by or licensed to DELTA YOU.
  • You receive a limited, personal, non-commercial licence to use the content for your own education. You may not copy, share, resell, publicly post or use it to train competing products or AI systems without written permission.
  • If you send us a testimonial, review or results story, you grant us permission to use it (with your first name, age and result) in our marketing. Email us any time to withdraw future use.

1.5 Payments, subscriptions and payment plans

  • Prices are shown at checkout in the displayed currency (typically USD) and processed securely by our payment partners (Stripe and PayPal via the Kajabi platform). We never see or store your full card number.
  • Subscriptions renew automatically at the displayed interval until cancelled. You can cancel any time from your account settings or by emailing support; cancellation stops future charges and access continues until the end of the paid period.
  • Payment plans are a full purchase paid in instalments. All instalments remain payable even if you stop using the product, unless the purchase is refunded under the guarantee or the law.
  • If a renewal payment fails we may retry it and pause access until payment succeeds.

1.6 Acceptable use

Do not misuse the Services: no sharing paid content, scraping, reverse engineering, harassment in communities or chats, cheating other members, or unlawful activity. We may suspend or terminate access for serious or repeated breaches; if we terminate without cause, we will refund the unused portion of anything you prepaid.

1.7 Disclaimers and liability

  • We teach evidence-based study skills and provide coaching and tools. We cannot and do not guarantee any specific grade, mark, ATAR, admission or outcome; results depend on individual effort and circumstances. Testimonials on our sites are from real students; their results are genuine but not typical promises.
  • Our Services are educational. They are not medical, psychological or professional advice. If a student is struggling with their mental health, please seek qualified help.
  • To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss. Nothing in these Terms excludes liability that cannot be excluded by law, including your rights under the Australian Consumer Law (see section 5).

1.8 Changes, notices, governing law

  • We may update these Terms from time to time; the “Last updated” date will change and material changes will be notified by email or a site notice. The version in force when you purchased governs that purchase.
  • These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales, and we will always try to resolve any issue by email first, quickly and fairly.
  • If any provision is found invalid, the rest remains in force. Our not enforcing a right is not a waiver of it.

2. Privacy Policy

2.2 How we use it

  • To deliver what you bought, run your account, process payments and refunds, and support you (performance of contract).
  • To improve our programs, personalise content, and measure marketing (legitimate interests).
  • To send you educational emails and offers, which you can stop any time with one click on the unsubscribe link (consent).
  • To meet legal obligations (tax, accounting, disputes).

2.3 Who we share it with

Only with providers who help us run the Services: the Kajabi platform (hosting and courses), Stripe and PayPal (payments), email delivery providers, analytics and advertising measurement tools (for example Google Analytics, Meta pixel and server-side conversion tracking), and AI infrastructure providers that power our study tools and chat (conversation content only, never your payment details). Each is bound to protect your data. We may also disclose data where the law requires, or as part of a business sale with equivalent protections. We never sell your personal information.

2.4 International transfers, security and retention

Our providers may store data outside Australia (for example in the United States). We use providers with appropriate safeguards. We protect data with encryption in transit, access controls and least-privilege practices, retain it only as long as needed for the purposes above or as the law requires, and then delete or anonymise it.

2.5 Your rights

Depending on where you live (Australian Privacy Principles, GDPR, UK GDPR, CCPA and similar), you may request access, correction, deletion, restriction, portability, or object to processing, and withdraw marketing consent at any time. Email [email protected] or [email protected]; we verify identity and respond within 30 days. You may also complain to your local privacy regulator (in Australia, the OAIC).

2.6 Children's privacy

We design our teaching for school-aged students, and we design our data practices around the adult account holder. Where a student under 16 uses the Services, a parent or guardian must have created or consented to the account, and we collect only what is needed to deliver the learning experience. Parents can review or delete their child's data by contacting us. If we learn we hold data collected from a child without appropriate consent, we delete it.

2.7 Cookies

We use cookies and similar technologies for login and preferences, analytics, and measuring our advertising. You can limit cookies in your browser settings; core features may not work without essential cookies.

3. Refund & Guarantee Policy

3.1 The Smart Student Masterclass: “Smarter in 30 Days or It's Free”

  • Email [email protected] (or main support) within 30 calendar days of purchase with the name and email used at checkout.
  • We refund every cent of the purchase price to your original payment method, normally within 7 business days of approval (banks can take a few days more to show it).
  • No completion hoops. We may ask what didn't work for you, purely so we can improve, and answering is optional.
  • Downloadable bonuses (workbook, slides, cheat sheets) are yours to keep, exactly as promised on the sales page. Access to the course itself and to ongoing-service bonuses (like an Academy trial) ends when the refund is processed.
  • The same guarantee applies whether you paid in full or by payment plan; a refund cancels remaining instalments.

3.2 Subscriptions and memberships (Smart Student Academy and similar)

  • Cancel any time in your account settings or by email. Cancellation stops future charges; your access runs to the end of the current paid period.
  • Because membership content and coaching are consumed as you use them, periods already billed are generally not refundable, except where a specific offer states its own guarantee or where consumer law gives you a right to a remedy.
  • Free trials convert to paid at the end of the trial unless cancelled first; we state the price and interval clearly before you start.

3.3 Coaching, live programs and challenges

Programs with live delivery (for example the 21-Day Challenge or Accelerator cohorts) state their specific guarantee on their own sales page at the time of purchase; that stated guarantee governs. Where none is stated, fees are refundable up to the program's advertised start and non-refundable after delivery has begun, subject always to consumer law.

3.4 The legal bit

This policy adds to, and never removes, your statutory rights, including consumer guarantees under the Australian Consumer Law and any mandatory cooling-off rights in your country. Third-party processor fees are absorbed by us on guarantee refunds: you get back what you paid.

4. AI Features Disclosure

  • Parts of our Services are powered by artificial intelligence: SMARTR AI study tools (learning, flashcards, homework help, exam preparation, coaching) and some of the chat assistance on our websites and in our session rooms.
  • Our AI assistants are designed to be honest: if you ask one whether it is AI, it will tell you. A human is always reachable at [email protected].
  • AI-generated answers can occasionally be imperfect. Verify anything high-stakes (like exam requirements or grades) with your school, and use SMARTR AI as a coach, not a shortcut: it is built to develop your capability, not to do assessed work for you. You are responsible for complying with your school's academic-integrity rules.
  • Chat conversations may be reviewed to keep the assistants safe, accurate and useful, and are handled under the Privacy Policy above.

5. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to cancel and receive a refund, or to compensation for any drop in value, and to compensation for other reasonably foreseeable loss or damage. Nothing in these Terms limits those rights, or the equivalent non-excludable rights of consumers in other jurisdictions.
